I’m really disappointed and rather bewildered that we can’t offer this valuable online ordering service to our community members. I’m curious as to how the website, which does not attach names to the pictures, infringes on the privacy of the students and staff, especially when we already splash their pictures and names across various public domains, including the Staff Directory, the XXXX publication, Staff blogs, and the XXXXXX among others. Please, if you will, explain the rationale behind this.

I’m also curious to know if you talked to any of the focus groups on this matter and learned their opinion on this subject. The community members I have spoken to over the past several months were enthusiastically in favor of this option.

Several of So and So’s clients, including the XXXXXXXXXXXXXXXXXXXXXXX right here in China, offer this same service to their community members. I’m wondering what’s different here in Shanghai.

Such decision was not hastily made by any individual, please see the rationale below and David and I will be more than happy to offer further explanation if there is still something unclear.

1. XXXXXX do attach individual name to all the photos, please see attachment, in addition to that, they put company name as watermark on each and every photo, this violate the contract we signed also may cause potential infringement of portrait rights. Moreover, the password will be shared company wide and there is no identification control to the purchaser, therefore you will never know who purchases your photo/merchandise for what purpose.

2. According to the “General Principles of the Civil Law of PRC”, without prior consent, one cannot use other’s photo for any commercial purpose. For our own publications such as XXXX, XXXXX we have written authorization from all the individual to use the photos for aforementioned purposes but such authorization didn’t cover so and so.

3. The price listed on the website is 15%-20% higher than the what we agreed in the contract.
